Brazilian construction company Andrade Gutierrez has made a public offering of unsecured short-term promissory notes on July 21.
The total amount of the offering is 130 million reais (US$80 million), and it was led by Caixa Econômica Federal. The notes will mature in July 2009.
Both Caixa Econômica Federal and Andrade Gutierrez took counsel from Machado, Meyer, Sendacz e Opice Advogados, due to a lack of conflict of interests in this type of transaction. Partner Elena Chimenti says: “It is always challenging to act as deal counsel, since it requires a perfect balance among the interests involved aiming at reaching an ideal agreement for both the parties and the deal itself.”
