Lawmakers understand that the bill needs to offer flexibility regarding the terms of the tax credit scheme and selection process, given that the industry is at a very early stage, according to legal firm Machado Meyer’s infrastructure and energy partners, Maria Fernanda Soares and Ana Karina de Souza. The new legal text aims to bring more clarity to the governance of the programme, but some level of subjectivity can be expected and future adjustments in the process might be needed depending on how the market develops, they say.
