Published on September 16, 2024, Law No. 14,973/24, among other provisions, added paragraphs 21 and 21-A to article 8 of Law No. 10,865/04, which provides for the additional Cofins-Importation.

According to the paragraphs introduced, there will be a gradual reduction of the additional 1% on Cofins-Importation, under the justification of compensating for the exemption from payroll, as previously discussed by our tax team.

This reduction will occur as follows:

  • 01/01/2025 to 12/31/2025: 0.8%;
  • 01/01/2026 to 12/31/2026: 0.6%; and
  • 01/01/2027 to 12/31/2027: 0.4%.

The measure should directly impact importers of the items listed in paragraph 21 of article 8 of Law 10,865/04. As an example, we list some of the sectors that will be affected:

  • Shoes;
  • Clothing;
  • textile;
  • leather;
  • machinery and equipment;
  • vehicles and bodies;
  • animal-based protein;
  • Transport;
  • information technology;
  • construction.
